पटना 11 जुलाई: भाजपा के पूर्व विधायक व लखीसराय जिला क्रिकेट संघ के अध्यक्ष एवं 20 जून की बैठक में बिहार क्रिकेट संघ के 30 जिला क्रिकेट संघ के द्वारा नामित अध्यक्ष प्रेम रंजन पटेल ने बीसीसीआई को मेल भेज कर बीसीए पर बीसीसीआई बैठक में निर्णय ले उचित आदेश देने को कहा है।

श्री पटेल ने प्रेस विज्ञप्ति से बताया है कि मैंने बीसीसीआई के अध्यक्ष सौरभ गॉगुली को मेल भेज कर निवेदन किया तथा अगामी 17 जूलाई को बीसीसीआई की एपेकस काउंसिल के होने वाले बैठक मे बिहार क्रिकेट एसोसिएशन के वर्तमान स्वरूप को भी एजेंडा मे शामिल करने की मॉग किया है ।

बिहार क्रिकेट एसोसिएशन के वर्तमान अध्यक्ष के तानाशाही रवैए के कारण बिहार क्रिकेट संघ चरमरा गया है । अतः मेरे द्वारा भेजे हुए मेल को देख कर उचित कारवाई करने का आदेश दे।

Sub: Request for including of status report of Bihar Cricket Association as one of the agenda   
         in the forthcoming meeting of the Empowered Committee of BCCI scheduled to be held on 17th of July 2020
 
Respected Sir,
            Most humbly, I would like to draw your kind attention towards the inept, unconstitutional and arbitrary style of working of the President of Bihar Cricket Association, Mr. Rakesh Kumar Tiwary, with an anticipation of a positive direction from your end may be issued, so that the purpose of constituting of the Bihar Cricket Association, Patna, through the elections held in accordance of the recommendations of the Hon’ble Lodha Committee and  by the interim orders of the Hon’ble Supreme Court of India,  be served in stricto sensu.
The factual matrix mentioned below would present a clear cut realistic picture of the Bihar Cricket Association (BCA), Patna, and the style of functioning of the President of Bihar Cricket Association in particular;
1.      The electoral process of BCA was conducted on 29.09.2019, on the basis of the recommendations of Just. (Retd) Lodha Committee, to elect the office bearers of Bihar Cricket Association, Patna, consisting of six posts. The elected candidates on the six posts respectively are :
·         President – Mr. Rakesh Kumar Tiwary
·         Vice President- Mr. Dilip Singh
·         Honorary Secretary- Mr. Sanjay Kumar
·         Joint Secretary- Mr. Kumar Arvind
·         Honorary Treasurer- Mr.  Ashutosh Nandan Singh
·         District’s Representative- Mr.  Sanjay Kumar Singh
2.      It is important to mention here that Ms Meera Pandey, the Electoral Officer of Bihar Cricket Association, Patna; out of 38 registered District Cricket Associations (full or voting members), allowed only those DCAs representative to participate in the process of election  who were eligible member of that DCAs Committees as per the recommendations of the Hon’ble Lodha Committee.
3.      Couple of months after the election was held, a writ petition bearing no. C.W.J.C.25002 Of 2019 was filed praying for cancellation of the election of Kumar Arvind, Joint Secretary Bihar Cricket Association, in the Hon’ble Patna High Court, Patna, alleging him that he remained the office bearer of District Cricket Association for continuously 10 years on the date of filing of a nomination for the said post which was contrary and in absolute violations to the recommendations of Just. (Retd) Lodha Committee by swearing a false affidavit keeping the Electoral Officer, BCA, Patna, in disguise.
4.      After the committee of the Bihar Cricket Association was formed on 02.10.2019, a meeting of the committee of management was held to empower them for smooth functioning of the office in accordance to the adopted by-laws of the BCA, consequential to the dissolution of the Three Men Supervisory committee constituted by the COA, BCCI for BCA.
5.      A meeting of the Committee of Management (hereinafter referred to as COM) of BCA, was held on 15.11.2019, wherein many necessary activities were decided to be taken up in order for the smooth functioning of the office of BCA including the appointment of its Hon’ble Ombudsman. It was specifically decided that a search and screening committee would recommend the name of the Ombudsman to be appointed in BCA and the same was penned down in Para no. 5 of the hand written minutes* of the meeting by the CEO. But in the typed copy of the minutes of the same meeting, the matter in Para no. 5 was manipulated on the behest of the President, BCA, and it was rewritten/typed as that the COM has appointed Just. (Retd) Mrs. Nilu Agrawal as Ombudsman of BCA and her salary fixed at Rs. 3 Lakhs per month, was no less surprise to the Secretary, BCA, Patna, and many other Secretaries of the different DCAs. This action of the President, BCA, Patna, cannot be justified by any cannon of law, rather it was admittedly beyond the provisions of the adopted by-laws of the BCA, apart it being a fraudulent act. Moreover, the President of BCA, under its own signature, also issued a letter of appointment to Mrs. Nilu Agrawal as the Ombudsman of BCA, that too without informing or taking the committee into confidence, for which he was, attributed to yet another irregularity/ illegality. Ironically the President of BCA also paid three months salary to the said Ombudsman without following financial provisions prescribed in the by- laws of BCA.
Consequences – On the basis of a writ application*, Patna High Court has stayed the appointment of the Ombudsman and has also refrained her to function as one, till the disposal of case.

6.      The President of BCA influenced the Ombudsman due to the undue favor granted to her, to curtail the powers of the elected Secretary, of BCA and removed him from one of the authorized signatory to operate the designated bank account of BCA. In furtherance, his signature was illegally replaced by the allegedly tainted Joint Secretary Mr. Kumar Arvind (whose election is also challenged in the Hon’ble Patna High Court, status pending due to Corona pandemic). It is important to note here that as per the Constitution/Bye Laws of BCA, which are amended as per and in conformity of the Hon’ble Justice Lodha Committee Recommendations, empowers the Secretary and Treasurer of BCA, to jointly operate its designated bank account.
7.      It is further stated that Sri Rakesh Kumar Tiwary, President, BCA, has allegedly convened couple of so called Annual General Meetings/Special General Meetings within a span of few months only, whereas as per the Constitution of BCA, ONLY ONE AGM of BCA can be held in one financial year. Moreover, in such alleged meetings, he allowed the members of debarred District Cricket Committees, which are constituted and run in contrary to the recommendations of the Just. (Retd) Lodha Committee.
8.      It should also be brought to your kind notice that the President, Mr. Rakesh Kumar Tiwary has contested the elections of BCA on the basis of a false affidavit/undertaking, wherein that he has sworn to be the Vice President of Gopalganj DCA (A FULL MEMBER UNIT OF BCA) on the date of nomination of BCA’s Elections, but as per the records of BCA, one Mr. Ramashankar Prasad was holding the said post of Vice President of Gopalganj DCA on the same date. A writ petition bearing token no. 8692/2020,, dated 03.07.2020, has been filed challenging the election of Sri Rakesh Kumar Tiwary as President of BCA, by Mr. Praveen Kumar, who was the runner up candidate for the post of President, in the elections held on 29.09.2019.
9.      It is also reported that a criminal case under various sections of IPC  420, 120 –B,  467, 468, 470,471, 504 and 506, has also been filed against Mr. Rakesh Kumar Tiwary, President, BCA, for submitting false affidavit during the nomination before the Electoral Officer, BCA, Patna, through complaint case in the Patna Civil Court, Patna, by one of the Office bearers of Madhepura DCA (a full member unit of BCA). In light of the above presented facts, it is therefore requested that your good office may kindly intervene in the interest of the young and extremely talented cricketers of Bihar, through its empowered committee(s) BCCI, Mumbai, and appoint a legal advisory team for looking into/investigating the above mentioned facts and also the other related relevant matters of BCA. However, it is for your kind information that the elected Honorary Secretary of BCA, has directed all the District Cricket Associations to reconstitute the Committees of their respective DCAs as per the recommendations of Justice Lodha Committee and submit the report of same to his good office
